You have entered the corporate website of OnCallMD, Inc (hereinafter “OnCallMD”), or one of its replicated websites, or Back-Office, or you are using the mobile application of OnCallMD (collectively the “Site”). OnCallMD shall be referred to herein as “OnCallMD”, “our”, “us” or “we”. This Site is operated by OnCallMD, and is hosted on the server of our third-party technology provider. By visiting this Site and providing information to OnCallMD you consent to the following privacy policy, use and disclosure of information.

INFORMATION COLLECTION

Information You Provide to Us. Through your use of or visits to our websites, you may be required or requested to provide personally identifiable information to us. Personally identifiable information is any piece of information that can potentially be used to uniquely identify, contact, or locate a single person including names, addresses, email addresses, telephone numbers, date of birth, social security and tax identification numbers, credit card or banking information, user name and password. 

Information Collected Automatically. We may collect certain information automatically when you use our Services, such as your Internet protocol (IP) address, device and advertising identifiers, browser type, operating system, Internet service provider, pages that you visit before and after using the Services, the date and time of your visit, information about the links you click and pages you view within the Services, and other standard server log information.  We may also collect certain location information when you use our Services, such as your computer’s IP address, your mobile device’s GPS signal, or information about nearby WiFi access points and cell towers.

We may use cookies, pixel tags, Local Shared Objects, and similar technologies to automatically collect this information.  Cookies are small bits of information that are stored by your computer’s web browser.  Pixel tags are very small images or small pieces of data embedded in images, also known as “web beacons” or “clear GIFs,” that can recognize cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device.  Local Shared Objects (sometimes referred to as “Flash Cookies”) are similar to standard cookies except that they can be larger and are downloaded to a computer or mobile device by the Adobe Flash media player.  By using the Services, you consent to our use of cookies and similar technologies.

INFORMATION USE

We generally use the information we collect online to:

  • Fulfill your requests for products, services and information;
  • Register and service your online account;
  • Provide information that you request from us;
  • Analyze the use of the Services and user data to understand and improve the services we provide;
  • Contact you about your orders;
  • Process credit card and debit card transactions;
  • Ship products to you;
  • Customize the content you see when you use the Services;
  • Conduct research using your information, which may be subject to your separate written authorization;
  • Send you promotional materials or advertisements about our products and services, as well as new features and offerings;
  • Enforce our Terms of Use or other legal rights and remedies;
  • Administer surveys, sweepstakes, promotions and contests;

SHARING INFORMATION

Healthcare Providers (and other healthcare-related entities). We may share your information with other health care providers, laboratories, government agencies, insurance companies, and other entities relevant to providing you with treatment options and support.

Authorized Vendors and Service Providers. We may share your information with third-party vendors and service-providers that help us with specialized services, including managing and operating our Site (email deployment, business analytics, marketing, including but not limited to advertising, attribution, deep-linking, direct-mail, mobile marketing, optimization and retargeting) advertising, performance monitoring, hosting, and data processing as well as billing, payment processing, customer service,. These third-party vendors and service providers may not use your information for purposes other than those related to the services they are providing to us.

Research partnersWe may share your information with our research partners to conduct health-related research; such sharing may be subject to your separate written authorization.

Corporate affiliates. We may share your information with our corporate affiliates that are subject to this policy.

Transfer in Sale or Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business or the Site to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your personal information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the applicable privacy policy unless you agree differently.

Legal Proceedings. We may disclose information to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims or government inquiries. If we are legally compelled to disclose information about you to a third party, we will attempt to notify you by sending an email to the email address in our records unless doing so would violate the law or unless you have not provided your email address to us.

At your direction and with Consent. We may share information for any other purposes disclosed to you at the time we collect the information or pursuant to your consent or direction.

Advertising. We may use how you browse and shop in order to show you ads for OnCallMD or our advertising partners that are more relevant to your interests. We may use cookies and other information to provide relevant interest-based advertising to you. Interest-based ads are ads presented to you based on your browsing behavior in order to provide you with ads more tailored to your interests. These interest-based ads may be presented to you while you are browsing our site or third-party sites not owned by OnCallMD.

We belong to ad networks that may use your browsing activity across participating websites to show you interest-based advertisements on those websites. Currently, our Site does not recognize if your browser sends a “do not track” signal or similar mechanism to indicate you do not wish to be tracked or receive interest-based ads. Please note that if you choose to opt out, you will continue to see ads, but they will not be based on your online activity.

Social Media. If you use third-party services, such as Facebook, Google, or Twitter, through the Site, to login to the Site, or to share information about your experience on the Site with others, these third-party services may be able to collect information about you, including information about your activity on the Site, and they may notify your connections on the third-party services about your use of the Site, in accordance with their own privacy policies.

Public Posts and Activities. If you choose to engage in public activities on the Site, you should be aware that any information you share there can be read, collected, or used by other users of these areas. You should use caution in disclosing personal information while participating in these areas. We are not responsible for the information you choose to submit in these public areas

Aggregate Information (non-personally identifiable). OnCallMD may share aggregated demographic information with our partners, vendors, suppliers, third party providers, and advertisers. This is not linked to any personally identifiable information.

Security. We use industry standard physical, technical and administrative security measures and safeguards to protect the confidentiality and security of your personal information. You should understand that no data storage system or transmission of data over the Internet or any other public network can be guaranteed to be 100 percent secure.  Please note that information collected by third parties may not have the same security protections as information you submit to us, and we are not responsible for protecting the security of such information. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that emails and other communications you send to us through our Site are not encrypted, and we strongly advise you not to communicate any confidential information through these means.

CHOICES AND OPT-OUT
You may opt out of receiving general health and wellness or treatment options that may be relevant to you by emailing us at support@oncall.md   You may also request that we delete your personal information by sending us an email at support@oncall.md  

You may be able to refuse or disable cookies by adjusting your web browser settings.  Because each web browser is different, please consult the instructions provided by your web browser (typically in the “help” section).  Please note that you may need to take additional steps to refuse or disable Local Shared Objects and similar technologies.  If you choose to refuse, disable, or delete these technologies, some of the functionality of the Services may no longer be available to you.

INTERNATIONAL USERS

We maintain information in the United States of America and in accordance with the laws of the United States, which may not provide the same level of protection as the laws in your jurisdiction.  By using the website and providing us with information, you understand and agree that your information may be transferred to and stored on servers located outside your resident jurisdiction and, to the extent you are a resident of a country other than the United States, that you consent to the transfer of such data to the United States for processing by us in accordance with this Privacy Policy. We are committed to protecting the privacy and confidentiality of personal information when it is transferred. Where such transfers occur, we take appropriate steps to provide the same level of protection for the processing carried out in any such countries as within the EEA to the extent feasible under applicable law.

MISCELLANEOUS

Changes to this Privacy Policy. OnCallMD reserves the right to amend or change this Privacy Policy at any time at its sole discretion. When we update the Privacy Policy, we will revise the “Effective Date” date above and post the new Privacy Policy.  We recommend that you review the Privacy Policy each time you visit the Services to stay informed of our privacy practices.

California Online Privacy Protection Act Compliance. Because we value your privacy we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We therefore will not distribute your personal information to outside parties without your consent.

Children. We do not knowingly allow individuals under the age of 18 to create accounts that allow access to our Services.

Online Privacy Policy Only. This online privacy policy applies only to information collected through our website and not to information collected offline.
